Valid XHTML when using Flash

Nowadays most of my clients prefer to have flash files included in their website. However I find it difficult to make them valid XHTML as the flash code doesnt pass the w3 xhtml validation.
I know there are some methods to overcome this issue which require javascript.
Is there any method that can work without the help of javascript and be cross browser compatible?
